Title: Just Because They Say Go Ahead And Sign Doesn't Make It Legal
Post by: Harness Racing Revolution on March 07, 2024, 02:43:24 PM
Two different cases this week of trainers signing transfers and the owners questioning later. First one guy was just arrested at Monti for signing a transfer he says the owner gave permission. Has the proof of payment. Now owner says still owed money, calls cops and on go the cuffs. In the real world "he said" means nothing. I suggested pay him the extra, get it in writing and have him drop the charges. Much cheaper than an attorney.

In New Jersey, similarly but with a partner involved who was not aware and the payment never got past the trainer of record. An unlicensed non USTA member signed the transfer. I was made aware of this last Thursday in Cream Ridge by the previous owner who didn't want to make a stink, but the partner is furious. I can confirm this other person was in fact acknowledged as 50% partner and was billed by the trainer accordingly. I obtained a bill to the partner for half the training bill of the horse. Trainer is listed, his address being that which is not his at all and the email address of an unlicensed non USTA member stable. I also have a copy of the forged transfer.  Can't make this up.

What are your opinions? In this day and age isn't it just safer to have the owner do the online transfer using Pathway?

I too heard of this happening with a horse racing at Monti. Owner asked about the horse, not knowing it had been sold. Trainer said something to the effect; horse stunk … I sold it.
Fear not - the owner got his money … but was not a happy camper the way it went down.

I always hear this. What is so difficult about doing it right. Then no area for issues. So fishy both ways.

I’ve seen this happen many times over the years. The owners are partly to blame for not doing their research before hiring a trainer. With the cost of caring for a racehorse these days you are asking for trouble hiring a trainer charging $30 a day.

Not the fucking owners fault or is there a disclaimer on the bills saying its your fault if you believe what is I say or do is true? ngc3

I WOULD STAY OUT OF IT AS ITS NOT MY BUSINESS. AT THE END OF THE DAY, THESE OWNERS TODAY ARE VERY SHARP AND KNOW WHAT THEYRE DOING WHEN THEY HIRE CHEAP ASS TRAINERS AND HAVE NO INTENTION OF PAYING A BILL. THEN BOO HOO WHEN THE TRAINER HAS TO SIGN THEIR NAME JUST TO GET HIS MONEY. I REALLY WISH ALL OF THE TRAINERS WOULD FORM A UNION AND MAKE IT MANDATORY THAT OWNERS HAD TO PAY ONE MONTH TRAINING SECURITY DEPOSIT. LIKE A FIXED AMOUNT LIKE $1500 AND ALL TRAINERS AND OWNERS WERE BOUND BY IT. THEN THERE CANT BE ANY AFTERMATH LIKE THIS. THE OWNER DOESNT PAY AFTER THE FIRST MONTH, THE SECUIRTY DEPOSIT GOES TO THE TRAINER AND THE OWNER MUST MOVE THE HORSE TO ANOTHER TRAINER AND PUT UP ANOTHER SECURITY DEPOSIT. MAKES THINGS SO EASY
