1) Per Engblom's positive on a Class1- has been treated very differently than similar cases in other jurisdictions.
One fact--if HISA was in charge-he would already be doing time-and in NYRA own regulations a Class 1 positive gets you immediately summarily suspended--ie this means the immediate suspension of a permit issued by the state regulatory authority without the permit holder being granted the opportunity to contest the action prior to the effective date and time of the suspension--ie you are on the sidelines. You automatically get a 10 year suspension in NY state-for a Class 1.
The contamination argument doesnt sound feasible either--because a horse having been contaminated with 3 different medications would have killed a human . This case IMHO is a very serious charge-the worst offence there is in racing-so anyone who if found guilty-should never have been allowed to race until it was settled.
2) Linda Toscano---entered a horse last Monday in the last race-American Dealer. Buddy of mine-a serious handicapper called me and wondered how this horse was allowed into that race.
a) The condition sheet stated that the event was only for horses that have started 3-out of last 5 starts at Yonkers--this horse raced its last 3 starts at the meadowlands. So the entry should have been thrown out--and IMHO anyone else it would have been. What happened?? That condition was removed AFTER the draw!! and the race now open--but only Lindas horse of course was favored by that action. Every other horse entered had been racing at Yonkers
b) It was also for horses that were winners at Yonkers of NW 10000 /last 5 at their last start. The Dealer-won at the Meadowlands in a Nw 10000/last 4 -a different condition-making it ineligible.
My only conclusion-and Im no expert--was that somehow, they allowed Lindas horse in as a "favor'--the ineligible horse lay over the field as it was an Open pacer in a much lower Class and won easily as a red hot favorite at 1/2.
As an owner---my only concern is that Harness Racing be conducted fairly across the board--favoring certain trainers-is Un American and non Sportmanlike.

This happens at most tracks. The difference here is you have linked names of the “favored” of specific trainers. You have identified a very good handicapping tool of comparing original race conditions with the final ones. That is where many of the “drop and pop”. 1-2 horses .. “favors”…….

Thank you Parked-you are obviously much more experienced than I--Im only amazed at the different set of rules and regulations that are applied across the board in different Jurisdictions to different constituents--and seems to be contrary to the best interest in Harness Racing and its Integrity.

2 problems with this post. First HISA doesn’t suspend the trainer right away anymore. 2nd they handle cases of contamination a lot differently than race commissions. On test that could be contamination they meet with the trainer in private. If there is a reasonable case it is dismissed. 33 of the 35 possible contamination positives have been dropped so far. There is an editorial on Paulick report today that explains this. And links to the article from HISA.

As far as Linda goes. Was there an AE on the race? If not race office can change the conditions to fill the class. That is noted on every condition sheet

Yes--there was an AE---Three Grand. Again this IMHO was a clear case of them wanting this horse in the race--what other conclusions can you make?

Thank you=appreciated--I didnt know this about HISA--as I dont follow them. They are only involved in TBreds-Im not.
Per Engblom was interviewed---and as far as I know--it wasn't dismissed. If it wasnt--then my original post on this is the same.

Bond, I feel that the contamination argument has validity because the ship in stalls cannot be completely sanitized. That said, it does seem odd that only one horse had a positive test for three different drugs in its system. I would think if contamination was the case there would be multiple positive tests on horses racing at the same track.

how is NYRA involved here?
they are a tbred entity looking over Aqueduct, Belmont and Saratoga
they have nothing to do with harness racing

I was just going to ask the same question.

You’d also have to account for the horses that get tested (less than 10% do) and have to account which horses interacted with the environment that caused the positive more. The whole you can get the same effects from a drug at 1/1000th of the recommended dose doesn’t really hold water for me. That’s like claiming you can get black out drunk with a sip of beer.

There is no legal appeal they should all be on day off and fined.

THAT DOESNT TAKE AWAY THE FACT THAT THIS IS ONLY DONE FOR CERTAIN INDIVIDUALS. AS FAR AS I'M CONCERNED, ITS RACE FIXING, OR TAMPERING AT THE VERY LEAST. IF THEY ARE GOING TO DO SOMETHING LIKE THAT, AT LEAST CALL ALL OF THE ENTRANTS AND LET THEM KNOW THE CONDITIONS OF THE RACE HAVE BEEN CHANGED AND ALLOW THEM TO WITHDRAW THIER ENTRY. THATS COMPARABLE TO GOING TO THE GROCERY STORE AND WHEN I GET TO THE CHECKOUT LINE, THE CASHIER TELLING ME THAT THE ITEMS PRICES WERE CHANGED BECAUSE THEY HAVE THE RIGHT TO DO SO. ITS TOTAL BULLSHIT BUT THATS WHAT THESE RACE SECRETARYS AND TRACK MANAGEMENT DOES TO PEOPLE. BEFORE LONG YOU ARENT GOING TO BE ABLE TO ENTER YOUR HORSES. YOU WILL JUST PAY FOR THE HORSE AND TURN THEM OVER TO TRACK MANAGEMENT TO RACE THEM IN WHATEVER THEY FEEL THEY WANT TO

This is where the big stables get the breaks. RS knows they have horses. Call and ask if they can use them. Win, win. They get a horse in a lower class and a break later on when one needs some class relief. And that is where the 1-5 odds come from ..

This entire industry is full of cheating etc...its a criminal enterprise.

The USTA and the Commissions definitely are not a joke, because a joke is funny and this situation is SAD!
-
I am so sick of everyone who gets caught crying contamination. Per wins at a remarkable rate.

They are a joke, albeit a sick but a joke nonetheless
