Whats the need for COMMISSIONS and JUDGES

Definition of COMMISSION....... .a group of people officially charged with particular function

Definition of JUDGE...A PERSON WHO IS QUALIFIED TO FORM OR GIVE AN OPINION


Why does this industry have either ????

Beards ,money laundering , tax evasion....this industry is a disgrace


Oh the commission and judges make decisions that are for the betterment of the industry

USTA allows fraudulent transfers so all of the guilty people continue to race.....laughabl e

Get a bad test just appeal it buy all the time you can most have no ground to appeal this should never happen get rid of these guys.

Judges have nothing to do with positive tests. All commission and jurisprudence, just like Trump, just keep appealing.

You will see the current governance model, or lack thereof, completely change over the course of the next five to ten years. The USTA can continue to be assumptive, presumptive, or even continue to "power-grab" whatever purview or areas they wish. They are not a governing body. Period. They----or perhaps just Williams and Faraldo----may think they are. However, the fact is, they are not. The inherent conflicts of interest, the favoritism, the blind-eye and deaf-ear approach and attitude, and so much else of what we see today, will, little by slowly, diminish and disappear from today's landscape.

Will there always be people cheating? People looking for an edge? Absolutely. You have it in every business. The stock market is no different. You see far less of the Mike Milken's and Ivan Boesky's today than twenty, thirty, and forty years ago. Yes, you still have crooks and thieves, like Raj Rajaratnam, but you will see----that is a function of the crook stealing, rather than the entire market or system being broken. Today, harness racing is broken. It is being fixed. You may not believe that or like how it's being done, but like I've always said, harness racing, and yes, the Meadowlands, will be around a lot longer than anyone here. So will Woodbine/Mohawk, and so will several other tracks. You will see less tracks in the end, and that's a good thing. On the t-bred side, Gulfstream will not only survive, but will thrive. So will Belmont, if NYRA doesn't run it into the ground, but if they do, the state will take it back or a new franchisee will come in and take over. Maybe 1/ST? LOL. The one that scares me here is CD. Eat what you kill can take you very far. I think being publicly-traded can be a big edge for them.

The next five to ten years, are you nuts. You will be lucky to have harness racing at all or maybe a few big tracks and fairs left.

The problem is the result of harness racing lo longer contributing tax dollars to the states. Under the outdated pari-mutuel tax formula, harness racing does not even generate the salaries of the piss catchers, let alone a fully staffed commission, regulatory and investigative unit.
So, when there is a severe enough breach in the rules, the commission has no budget to do it's duty. They will impose a fine and or suspension but little if anything else.
and as we all know , about $50K in legal fees will keep you in business for a couple of years before you exhaust your appeals.

 Now, if there is systemic lawlessness or a rash of positive test, the commission would request the state give special resources to them to police and investigate. The state will more than likely sit on it and do nothing. Meanwhile, the thieves get bolder and bolder. The innocent can no longer compete and fade away.  The sub powers keep the train rolling as long as it suits and profits them.
 
 I would like to think we are at the breaking point. In New York, I don't see anything happening until the new casinos are awarded in the NYC zone.
When we saw Ross Cohen testify at an federal trial, he paid drivers at Yonkers and named names to stiff their horses and nothing ever happened in NY, it was quite convincing NY has no interest in investing into mission to clean-up harness racing. Why? Well let's say the spend the time and money and they are successful in getting rid of some bad boys, what is the payoff for NY State? It is zilch . Possibly even worse.

So, as long as racing continues to use the same formula to fund a commission with a real regulatory and investigative component, we will get the same results.
