Tross: In a character defamation case doesn't the person filing the suit have to prove that he suffered monetary losses for it to be successful?
i am not a lawyer but i do not think so.proof of $$$ losses is what is used to determine what the $$$ award would be for damages.i have read of cases where the person who was defamed was making more $$$ after all the bad publicity and was awarded $00 by the court.
What I was trying to get at was if the person filing the case cannot prove any $$$ losses, the case goes through the window. No?
