And like I said, you’re just splitting hairs. The fact of the matter is also that people on this forum very often test credulity with their use of the word ‘criminal’ after watching too many episodes of Law and Order to the extent that it has little to no meaning here anyway. You might first have to put it back into some kind of meaningful context before quibbling about anyone’s use of it. It’s not like you cited the exact verbiage that would have accurately quoted the rules yourself. More than likely they use words to the effect of ‘felony record’. Which yes, I’d argue is essentially saying ‘criminal’.

Last time he was suspended I think the horses were under Gaetan Hebert's name. Menary's horse won and he was in the winner's circle. I think there's even a photo in one of the old woodbine/mohawk threads.

Here's one of the posts and this is true what he said. Chody kept referring to Menary as trainer.

When Sintra won the Canadian Pacing Derby Final Gaetan M Hebert was listed as trainer.

Trainer Dave Menary was/is listed as one of the owners.

When Jamison was doing his interview he kept giving credit to Menary then correcting himself to Hebert.

Tonight in Mohawk's 10th race Sintra is back and in the Preferred this time with Menary listed as trainer.

Why was Hebert listed as trainer for the Canadian Pacing Derby?

He had a suspension for being drunk in the paddock

Nothing to do with any positives
He was permitted on the grandstand from what people were told

Well that’s all I was told I asked other trainers
They all tell me he’s a drunk and has had multiple DUIs in the past

Just saying
That suspension had nothing to do with any positive tests

Anyways owner guirero sold all his horses with other trainers on Ongait a few weeks ago
Seems like he will stick to the gas trainers

In Hebert name BUT when it was race day the suspension had ended
