PA Code 58-183.336 .352 .355 .357 Mr. Allard`s horse Kings Barns failed the pre-race blood gas test on 8/25/18. He is fined $1000.00 and suspended 30 days starting on 10/5/18 and will remain suspended through 11/3/18. The horse is also suspended for 30 days which have already been served. During this suspension he and all horses owned and trained by him are barred from all grounds under the jurisdiction of The State Horse Racing Commission. Any transfer of horses must be approved by the judges at Pocono Downs or by the State Horse Racing Commission.

On September 25, 2018, The State Horse Racing Commission, Bureau of Standardbred Horse Racing a received a request for an appeal and supersedeas from Rene M. Allard of Pocono Downs Board of Judges Ruling #18048C. Upon review, the request for an appeal is hereby DENIED. The request for a supersedeas is also DENIED. As to the request for a stay, based upon weighing of the averments of record set forth by Mr. Allard and the well-established standards set forth in PA Public Utility Commission v Process Gas Consumers Group (1983), the Commission through its Director of Standardbred Horse Racing finds that: 1. Mr. Allard failed to present substantial evidence or otherwise make a strong showing that he is
likely to prevail on the merits. The history of the horse`s elevated TC02 is irrelevant after the horse was sequestered for 72-hours and all tests in that time period were confirmed to be below threshold; 2. Mr. Allard failed to demonstrate by any evidence or affidavit that he would be "irreparably" harmed without the requested relief pending final resolution of the merits; 3. The issuance of supersedeas in this matter would substantially and negatively affect other parties, including the Commission, the integrity of racing and the general public. This decision may be appealed to the Commonwealth Court of PA within 30 days.
