Big time Attorneys fill lawsuit on behalf of Hoosier park trainer

The word at Hoosier is that BIG NAME Indianapolis law firm Morgan & Morgan has been retained by a Hoosier park trainer, who’s name is being protected, and has filed a lawsuit naming the Indiana Race commission, the Hoosier park stewards, Rick Moore and Joe Morris.
Apparently this trainer has filed a lawsuit against them for the call or non call? Of On Time Ted from the 12th race on Thursday the 14th when the stewards put an inquiry on On Time Ted for a pylon violation. After review the stewards said that he DID GO inside one pylon leading into the open stretch but did not gain an unfair advantage so he was upheld the winner.
This lawsuit claims that the decision they made compromised all the other times they took horses down for going inside one pylon.
Apparently this unnamed trainer produced betting tickets that would have paid him six figures of winnings from a previous race where they disqualified a horse for doing the exact same thing On Time Ted did and was left the winner.
Word is that Rick Moore and Joe Morris are Steaming mad over this and furious this trainers name is under seal by these big time attorneys.
Stay tuned on this one this guy has got some people nervous in the front office??

I call BULLSHIT on this!

For one thing Morgan and Morgan are injury lawyers and only take cases that they can get part of a judgement. I'd be very surprised they touch something like this..Post the complaint since you know all the details! Or did a lil birdie tell you this garbage?

Regardless of all the BS what is the key element here is the total inconsistency regarding pylon infractions. I have written about this before on Plop but no one has good answer. The only good answer is a national rules and enforcement commission with one set of rules. The sport cannot continue to rule differently on the same infractions from track to track. I have no idea who this trainer is but it doesn’t matter does it? I don’t even need to watch the replays. This story repeats itself regularly all over the harness world. So either put back the unsafe wooden rail or get the rules and execution fixed once and for all.

A decision in favor of the plaintiff would send Shockwaves throughout the pari-mutuel world! Suddenly those who thought they were untouchable would be on notice! I would not be surprised if this case came to a close with a sealed settlement! The casino companies will pay the cost in lieu of the negative connotations!

Have you submitted yourself for drug testing?  You may also need psychotherapy.  Morgan & Morgan do not do litigation of this manor.  Secondly, go look up the rules and you will see that one pylon is not a violation.  Two consecutive is a violation and you will be placed.  Now if you only go inside one and go off course your coming down as well.  At any rate it's under the discretion of the judges.  Gambling is a risk and once that race is ruled official it's all over.  If the winner of the KY Derby gets a positive and the 2nd place horse is 90-1, you don't get to take your tickets back to Churchill to get your 180.00!  Next time put some more thought into the story.  Maybe make it a driver is suing for sexual harassment or someone wants to be known as Suzy instead of Jim.  Get creative and do more drugs and you can probably come up with something better than a 100K loser over a pylon violation.

Hoosier changes the pylon rules daily. I’ve already seen very similar violations with different judges. It looks bad from the grandstand. There is no way they can give a human being this type of discretion and not make a mistake. I don’t know about the lawsuit they have coming their way, but I will say nobody seems to be able explain why the rules aren’t equally applied to everyone. Trace constantly goes inside pylons without ever being questioned. Like I said it looks bad. Make one rule and put a stop to the madness.
