This appeal Should not be allowed past 30 days, and if rescinded at any point by the defendant, it should be an immediate suspension to be served concurrent to the appeal rescission, or denial by the commission.

In 2023 Burke had a total of 5,053 starters. Can you imagine the impact on the tracks if he gets thrown out for all his drugging infractions? The next 2 trainers had totals of approximately 1,750 starts.

All tracks would benefit greatly, those horse would divide up to multiple trainers. Instead of one trainer with 5000 starts they would given to multiple trainers which would greatly help entry shortage. There’s not a horse shortage problem, it’s a trainer shortage problem.

Really? 7 horses? In 6 to 8 weeks? Well, I don't follow the t-bred game, but I know a lot of people in it. If this is accurate, I would think that the headlines would be very clear in reporting this. No vagueness, no innuendo, simply "Baffert barn has 7 horses die in 6 weeks" or "7 horses die in Baffert stable in 8 weeks" -- and while I don't follow the t-bred game, these headlines I wouldn't have missed. 2023: Baffert has a history of horses dying under his care. According to the Washington Post, at least 74 horses have died in Baffert’s care in California since 2000. When factoring in the number of races run, Baffert’s horses have died at the highest rate of the 10 trainers who have had the most horse deaths, per the Washington Post's analysis.

There is no legal ruling in America where you are not allowed time to consider an appeal. I agree that if appeal is dropped there should be serious consequences not this dropping the penalty that most states currently do. Any appeal cost the state commission money

.......and now this new one!  Mass. 205 CMR 3.21 (7), 3.29 (1)(a),(g), 2(a). On 11/08/2023 Industrial Labs reported to the Massachusetts Gaming/Racing Division the post race test result of Urine Sample E630127, collected from the horse EVERY MANS DREAM on 10/16/2023. The test revealed the presence of Gabapentin in the urine. Trainer of record Ron Burke was notified and exercised his right to a split sample. The split sample E630127 was forwarded to an independent lab of his choice and on 12/06/2023 the lab report from New York Drug Testing confirmed Gabapentin in the urine. On 01/29/2024 a hearing was conducted virtually and as a result Mr. Burke is hereby issued a full suspension for 45 days beginning 02/01/2024 through 3/16/2024. In addition he is fined the sum of $2,500. The horse EVERY MANS DREAM finished 1st and is disqualified. The purse money won, $37,500.00, is hereby ordered forfeited, returned and redistributed. Purse monies forfeited must be returned within 10 days of ruling. The fine is due within 48 hours of imposition. Mr. Burke has 10 days from date of ruling to appeal this decision in writing to the Massachusetts Racing Division.

From the San Diego Union-Tribune (November 21, 2013)

Seven of Baffert’s horses died of sudden death between Nov. 4, 2011 and March 14, 2013. Five died in training, two in racing. Five died of cardio-pulmonary failure. Arthur said the amount of deaths “is undeniably exceptional,” but the “cases were not atypical sudden deaths associated with racing and training.” He called the cluster of horse deaths in Baffert’s barn, “extremely abnormal,” and later said, “There is something wrong here.”
All seven of Baffert’s horses that died were taking a legal thyroid hormone that was prescribed by a veterinarian at Baffert’s request. Baffert told investigators he’d been using the hormone, Thyro-L, in his horses for over five years. But Arthur said Baffert quit using the medication after the seventh horse perished.
