Exactly why I started this topic.  Eric and Maurice will fuck their own mother for money.  Talk around YR is there are about 5 trainers who are looking to file a class action lawsuit against ongait and get them shut down.  They are bad for harness racing and owners and trainers are starting to wake up.  Erv an do whatever he wants on there. The place is sinful

I don't love the people at ongait but what are they suing for?  They are a horse marketplace who implicitly say they do not guarantee anything.  Am I missing something. it is total buyer beware.

How can you say that when they knowingly allow a guy like Erv to sell horses with three legs and post pics of a four legged horse that of course you won’t get? I mean ongait has become the laughing stock of harness racing.  I’m telling you, it’s just a matter of time.  Just like the guys sitting in jail now with surrick. They knew he was juicing. Everyone gets caught sooner or later and ongait knows what these people are doing on their website. At least put on a show and speak out about putting up lame horses or pics that aren’t the actual horse.  The federal government shuts down car dealerships that do the same shit here in New York.  They advertise a beautiful picture of a new car for $1000 and when you go to the lot to buy it the car has three wheels or has suddenly just been sold and they have another one just like it.  Total nonsense. But that’s ongait.  They know what they do.  Shit them down!!!!!!!!

Knowingly, prove that.  However you could sue Erv.  There are law for car dealerships, there are lemon laws.  This is Ebay.

I am not a fan on ongait, or Eric, or Maurice. However, nobody truly knows, nor can prove, that there is duplicity between them and (in this case) Erv Miller. If you have the proof, and you were a victim, so sue them all. If you don't, then as usual, this is nothing more than rumor and innuendo. That aside, check out the language in the ongait contract. Eric Cherry, while he may be a deceitful, lying, scumbag, is not an idiot. He's paid more money in legal bills than most people earn in 5 to 10 years, maybe more. Ongait has shifted the risk to the buyer. Period. Buyer beware.

If someone is selling a horse and using old pictures, or whatever fraud they are committing, if Eric in unaware, he's protected. If Eric is aware, and involved, prove it...and as much as I'd like to see that...good luck with that.

I bought one horse off ongait. I didn't want to, but I did, LOL. I sent a trainer, he sat behind the horse, and we had him fully vetted, x-rays, full blood, etc., and all. I got the horse at my price. I did everything I could possibly do for my due diligence. Buyer beware.

You are joking right? So if I bid on a horse by the owners statement on ongait and prove that statement was wrong and the horse was misrepresented, Eric and the seller should just walk away if I don’t have the legal means to sue them? You sir are part of the ongoing problem with harness racing.  I fully understand when you say prove it because obviously I can’t. But it doesn’t take a rocket scientist to know you got fuvked by the seller and ongait because they knew damn well what Erv and others do.  They just turn a blind eye. Think about this.i now say to myself, why would anyone sell their their horse on ongait? Because they can misrepresent a lame horse as sound and get away with it. That’s why. The only thing left to do is simply not buy a horse from ongait. I might try the other online auctions but I’ve seen enough of Maurice and Eric’s bullshit.

I'm sorry you feel that way. No, actually, I am actually a smart, educated buyer and I know the rules---and the game. If you want to deal with a crook, be prepared to get robbed. It's that simple. Go read the contract and know who you can sue and who you can't. Nobody has to do business with them. If you choose to, you are signing their contract. Period. Your choice. Is it fair? No. But you are making the decision.

Read the contract language. It clearly states the owner's statement and/is just that---the owner's statement or consignor's statement. Every auction, sales company, etc., has the same language:

Example: From the Black Book/Harrisburg: "The foregoing statement has been prepared by the consignor of this horse. The Sales Company does not confirm or adopt the statement. Bidders are directed to the terms and conditions of sale printed at the front of this catalog for a review of the respective rights and duties of consignor, the Sales Company, and purchasers."

And, with the contract language...I think a buyer who falls victim to fraud, would have a lot higher success suing the seller, than they would Eric Cherry. However, unfortunately, at the end of the day every seller, every auction and sales company has the same absolute protection...cave at emptor. Fraud opens the door, so let someone go through it. While it was a private sale, I am sure Pollock explored every possible option with Funtime Bayama.

Now you really have to be kidding. Please don’t ever compare Harrisburg to ongait. Just saying that once something is brought to Ongait’s attention, they should at least do the right thing and ban the seller who misrepresented the horse. But instead they turn a blind eye and continue to let Erv and Rodney long rip off their customers because they get listing fees and commissions.  I understand that Ongait isn’t responsible for the seller listing a broken down horse in their auction and lying, but for Christ sakes at least ban them from ever doing it again.  Erv has done it to multiple people. It’s just not cool to keep allowing their sellers to commit fraud and them claim buyer beware.  Come on now.

I went to Harrisburg for the first time in 5 years...I saw more horseman having yearlings vetted than ever before

Are you truly being that simplistic, or just not reading. I did not compare the two. I gave an example. Go get the sales agreement from ongait---the actual contract---and you will see very similar language; difference being state-specific vis a vis contract law. I'll try to make this very simplistic, and I'll type slower if that helps---your recourse against both sales/auction companies, any sales/auction company, is simply extremely limited to none. Is it fair? No. But if YOU made the decision to sign a unilateral contract, then caveat emptor. You bear the consequences of your own decision. Recourse against Erv---sure, you can try. Go right ahead. Go lobby ongait to ban Erv. Go make your case that Erv was guilty of fraud. Go do whatever you want. He's a crook. It's not fair. It's wrong. In the end, you chose to do business with him. Plenty of people have done business with ongait and did not get screwed. I don't like it, nor Eric, but that's the truth.
