Was wondering if the following decision (or non-decision) is arbitrary or not. Toga Race 5 on the final turn the 3 horse breaks on lead. The 5, sitting the pocket the entire mile behind the 3, has no choice but to go inside the infield, and reemerges onto the track after being inside 3 pylons. He wins race, inquiry light is on, and he is kept up (quickly). Clearly he had no choice as to what he could do given the circumstances, but did the horse ultimately not gain an unfair advantage? Yes, I did have a vested interest in the race; result was 5-1-6-9 and I of course had the 1-6-9 triple. A small triple pool ($12k - good for Toga though), but the 1-6 exacta was coming back $540 so the triple would have been healthy.
